EIN vs ITIN: Which Tax Number Does a Foreign LLC Owner Need?

Understand the difference between an EIN for your LLC and an ITIN for you, including the SS-4 line 7b exception and separate personal tax obligations.

An EIN identifies your business entity. An ITIN identifies an individual who needs a US federal tax identification number and is not eligible for an SSN. An overseas founder may need an EIN for an LLC and, separately, an ITIN for a personal tax purpose. Receiving one number does not issue the other. IRS taxpayer identification numbers.

For a foreign-owned US single-member LLC, start with the document or obligation asking for a number. Determine whose identity it concerns before choosing an application.

Can the LLC get an EIN before its owner has an ITIN?

The SS-4 instructions permit foreign or N/A on line 7b when the responsible party has no SSN or ITIN and is ineligible to obtain either. Both conditions matter. Having never applied for an ITIN does not establish ineligibility. SS-4 instructions for lines 7a and 7b.

Use the actual responsible party on line 7a. Do not put a provider’s personal number on the form to make an online application work. When should the owner consider an ITIN?

Review the owner’s personal US tax situation separately from the LLC’s application. An ITIN application requires a federal tax purpose and ineligibility for an SSN. Form W-7 generally accompanies a federal tax return, although specified exceptions exist. The supporting identity and foreign-status documentation is part of that separate process. For example, an owner preparing a personal US tax return may need an individual taxpayer number even though the LLC already has an EIN. Conversely, a business EIN application alone does not prove that every owner must submit W-7. Confirm the relevant filing requirement and any exception before ordering an ITIN service.

When a bank or platform asks for a tax ID

Ask whether it wants the entity’s EIN, the owner’s individual number, or both, and which supporting documents it accepts. A field labeled tax ID can refer to different people in the same onboarding process. Keep the LLC name, owner name and corresponding numbers separate in your records.

An EIN or ITIN does not guarantee account approval. The institution can request additional ownership, identity and business information. If it needs business EIN evidence, review CP575, Letter 147C and fax replies.

Common questions

Do I apply for an EIN and ITIN on the same form?

No. SS-4 and W-7 have different applicants, requirements and purposes. A service offering both should explain each application separately.

Can I use my LLC’s EIN on my personal tax return as my own number?

An entity’s EIN does not replace the individual’s required taxpayer ID. Follow the instructions for the personal return.

Does EINPilot obtain ITINs?
